PERSONAL DATA USE POLICY

This Personal data USE POLICY (hereinafter – the Policy) regulates the use and processing of personal data by the bisseti.space website. 

1.MEANING OF TERMS 

The subject of personal data is an individual whose personal data is processed.

The recipient is an individual or legal person to whom personal data is provided, including the Site Administration and third parties.

Site/Recruiting agency (further – Agency or site) – a website owned by the Site Owner and having an Internet address bisseti.space on which information about services, terms of their purchase (receipt), payments, events is/can be posted advertising and marketing nature, other general information addressed to an unspecified circle of persons, on the basis of which any person (User) can make an informed choice and use the Agency’s services, enter into an agreement with the Agency on the provision of services on the terms set forth in the Public Offer Agreement.

User is an individual (or a legal entity acting on behalf of individuals) who has reached the age of eighteen or has received consent from legal representatives to use the site, whose personal data is processed.

Personal data – information or a set of information about a natural person who is identified or can be identified.

Processing of personal data – collection, registration, accumulation, storage, adaptation, modification, updating, use, distribution and destruction of personal data, including using automated systems.

Consent of the subject of personal data is the User’s permission to process his personal data.

Third parties – persons who provide auxiliary services to the site for the Agency to fulfill the terms of the Public Offer Agreement for the User (in particular, the provision of personnel / Employer recruitment services), as well as any other persons. Third parties may be recipients of personal data.

Public offer contract – a contract concluded between the Agency and the User, which regulates the rules for the User’s use of this site and the provision of recruitment services / Employer.

  1. GENERAL CONDITIONS.

2.1. Acceptance of the Public Offer Agreement by the User and the sending of personal data by the subject of personal data is the User’s automatic consent to the processing and use of the necessary personal data of the User on the bisseti.space website.

2.2. By providing his personal data and any other information for the site, the User gives the Agency his voluntary consent to the processing, use of his personal data, as well as the implementation of other actions for the provision of services and access to the functionality of the site.

2.2.1. The User consents to the transfer of his personal data to the Agency for the purpose of obtaining personnel/Employer recruitment services, giving the User the opportunity to familiarize himself with the information about the services posted on the website, choose the service and use it.

2.3. When using the site, the Agency can carry out both automatic and non-automatic collection of information (using both its own and third-party software/services) related to the User’s use of the site. At the same time, the Agency can use information and telecommunication systems and software for processing personal data and confidential information, which can be carried out automatically or without means of automation.

3.WHAT DATA DOES THE SITE USE?

3.1. The Agency may collect, store and use the following types of User’s personal data:

  • computer information, including IP address, geographic location, browser type and version, and operating system;
  • information about visits and use of the site, including the source of referrals, duration of visits, page views and navigation routes on the site;
  • information provided when filling out electronic forms, questionnaires on the bisseti.space website or in another way, for example, first and last name, gender, birthday, e-mail address, contact information, registered place of residence, actual place of residence ;
  • information generated when using the site, including when, how often and under what circumstances the site is used;
  • information about ordered / received services and transactions made through the Agency;
  • information contained in any messages that you send to the Agency by e-mail, messenger, SMS or through the functionality of the site.
  • other information necessary for the execution of the Public Offer Agreement.

3.2. The Agency may collect and use the User’s personal data for the purposes:

  • site administration;
  • entry of the User in the database of potential candidates / employers / clients;
  • provision of recruitment services / employers;
  • providing the opportunity to use the tools available on the site;
  • provision of advice, consultations and recommendations regarding services;
  • processing and fulfillment of requests, feedback regarding the provision of services;
  • clarifying the details of requests, appeals;
  • sending statements, checks, invoices, documents to the User;
  • sending messages via e-mail, messengers, SMS messages;
  • providing statistical information about Users to third parties (at the same time, third parties will not be able to identify an individual User with this information);
  • display of advertising materials through the site;
  • providing postal companies, payment services, banks with personal data in the amount necessary for the provision of services and the terms of the Public Offer Agreement;
  • consideration of requests and complaints;
  • keeping the site safe and preventing fraud;
  • verification of compliance with the conditions governing the use of the site;
  • other types of use for the purpose of providing services to the User.

3.3. It is considered the User’s personal information:

  • Full name, age, gender, citizenship, registered and actual place of residence, phone number, e-mail address, User accounts in social networks, personal photos, autobiography, all other information placed in resumes, portfolios, job offers;
  • information about the User’s education, provided by him and contained in: certificates, documents about education (name of the educational institution, period, type and form of education, date of graduation, faculty, received qualification, direction and specialty), level of foreign language proficiency, etc.;
  • information about work experience: information contained in the work book, work experience, previous places of work (names of employers, their details, dates of the start and end of work, position, unit, salary / remuneration information); information about customers with whom the User cooperated on the basis of a civil law contract (names of customers, their details, dates of the start and end of work for them, provision of services, type, scope and nature of work performed, services provided, place of work performance, provision of services , the project within which works were performed, services were provided), including all information contained in civil law contracts; the current amount of salary or income, as well as about the desired conditions, nature and type of work (position, place of work, work function, job duties, starting date, working hours, salary and bonuses), or about the desired conditions of cooperation on on the basis of a civil law contract (nature, type and volume of works, services expected to be performed/provided, expected level of income); information about employees of previous employers or clients with whom the User interacted in the course of employment, performance of work, provision of services and who can give recommendations about the qualification/skills of the User, the quality of the work performed by him, the services provided;
  • information provided by the User about professional skills and professional activities: qualifications and professional retraining, scientific works and developments, participation in associations, public and other organizations, etc.;
  • marital status and family composition;
  • any advice, consultations and recommendations of the Agency’s representative to a specific User on registration and provision of services, information on the history of provision of services and transactions;
  • information contained in the job offer from the employer to the Candidate (User), in particular regarding salary / remuneration conditions, functional duties, position, all other conditions;
  • information about the conducted interview: the results and progress of the interview conducted with the Candidate (User), answers to questions asked during such interviews, e-mail correspondence, the result of the Candidate (User) performing test tasks.

3.3.1. Additional personal information:

  • text messages between the Agency and the User;
  • any information received by the Agency from the User during registration and performance of services.

3.4. In the context of this Policy, is not personal data/confidential information:

  • information of an organizational and technical nature (for example, technical problems/questions regarding the registration and processing of requests for services);
  • information used and processed outside the bisseti.space site;
  • comments that remain publicly available on the bisseti.space website;
  • information that must be disclosed at the request of state bodies, competent institutions in accordance with the current legislation of Ukraine;
  • information provided by the User to third parties directly for the purpose of executing the Public Offer Agreement;
  • public information.

3.5. The Agency takes all necessary organizational and technical measures to protect personal data/confidential information from their loss, destruction, damage, unauthorized access.

4.HOW LONG DOES THE SITE (AGENCY) PERFORM PROCESSING

4.1. The period of processing of personal data is carried out for a period no longer than is necessary for the purposes of processing. The processing of personal data cannot exceed three years from the moment of their last update, use.

4.2. The processing of personal data is stopped, immediately, when:

  • The Agency has received a request from the User to withdraw consent to the processing of personal data, except for cases provided for by law or necessary for the functioning and normal operation of the site;
  • The site (Agency) has ceased its activity.

4.3. The processed personal data is destroyed or depersonalized by the Agency when the processing goals are achieved or in case of loss of the need to achieve these goals, as well as when the User withdraws consent to the processing of personal data.

4.4. The user may withdraw consent to the processing of personal data by the Agency by sending a message to the e-mail address: now@bisseti.com. The User’s withdrawal of consent to the processing of personal data causes the destruction of records containing his personal data on the bisseti.space website, including the deletion of the Personal Account/Profile (if any). 

  1. TO WHOM DOES THE AGENCY PROVIDE PERSONAL DATA?

5.1. The Agency may transfer and provide through the functionality of the site or in other ways:

  • to a potential employer with whom the Agency has concluded an Agreement on the provision of search and recruitment services;
  • to the employees of the Agency and involved consultants, including lawyers, accountants, administrators, IT specialists, heads of departments and other specialists;
  • postal (courier) companies have access to the User’s personal data/confidential information for the purposes specified in the Policy, in particular for delivery of documents and other items;
  • financial and banking institutions/payment services in order to provide the user with the opportunity to pay for services by electronic debiting of funds from the User’s account or by other means (if necessary);
  • to other third parties in order to ensure the possibility of protecting the rights and legitimate interests of the Agency, as well as providing services to the User.

5.2. Personal data/confidential information of the User specified in clause 3.3 may be transferred to potential employers. of this Policy.

5.3. Personal data/confidential information about the User’s first and last name, patronymic, phone number, e-mail address, information about the contents of the parcel may be transferred to postal (courier) companies.

5.4. In order to receive services, the User may transfer and disclose additional personal information directly to postal companies, a potential employer and other institutions, which is not subject to unauthorized disclosure to the Agency and other third parties.

5.5. The Agency undertakes to use personal data in good faith and in accordance with the legislation on personal data protection.

  1. RESPONSIBILITY.

6.1. The Agency may disclose to third parties confidential/personal information about the User, which it obtained as a result of granting him access to the site and data processing in the context of providing services only in the cases provided for in this Policy.

6.2. The Agency is not responsible for any action/inaction of a potential employer, third parties, which entails the unauthorized disclosure of personal data/confidential information about the User.

6.3. In case of non-fulfillment of the terms of the Policy on the part of the Agency, the Agency is responsible for the improper use of personal data in accordance with the norms of the current legislation of Ukraine and other international legal acts.

6.4. The user can submit requests/complaints to the Agency about possible illegal actions regarding the processing of personal data.

  1. MISCELLANEOUS.

7.1. The site administration does not verify the authenticity of personal data provided by the User, except for the cases provided for in the Contract on the provision of search and recruitment services concluded between the Agency and the Employer.

7.2. At the User’s request, the Agency can: delete/block his personal data, which are placed and processed on the site, provide all relevant information about his personal data and the purposes of processing.

7.3. The processing of personal data that does not meet the purposes of processing specified in this Policy is not allowed.

7.4. It is not considered a violation of the Policy to provide information to counterparties and third parties acting on the basis of a contract with the Agency, including for the provision of services to the User, as well as in cases where the disclosure of such information is established by the requirements of the current legislation of Ukraine, international legal acts.

7.5. The Agency can make changes and additions to the Policy, which are effective from the next day after the day of posting on the bisseti.space website.

7.6. Provisions and conditions that are not provided for in this Policy are regulated by the General Regulation of the Protection of Personal Data of the European Union (GDPR) and the current legislation of Ukraine.

7.7. The site may use cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and stored in the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies can be either “persistent” cookies or “session” cookies: a persistent cookie will be stored by the web browser and will remain valid until its expiration date if you delete it before the expiration date; A session cookie, on the other hand, expires at the end of the session when the web browser is closed. Cookies generally do not contain any information that personally identifies you, but the personal information we store about you may be linked to information stored and obtained from cookies.
